Procedure for certifying managers of the main areas in the construction technical activity bound to change

1 January 2017 will witness the entry into force of a new version of the Law on Construction that lays down new requirements for certification and recognition of rights.

In accordance with the existing legal regulation, qualification certificates are granted to architects and civil engineers who wish to assume the duties of managers in the major areas of the construction technical activity at construction works of exceptional significance. The new version of the Law on Construction stipulates that from 1 January 2018 qualification certificates and documents of recognition of rights will be compulsory also for managers of construction works of non-exceptional significance. For architects and civil engineers seeking a qualification certificate of a manager at construction works of exceptional or non-exceptional significance, the following qualification requirements have been set out: holding a higher education diploma confirming the professional qualification of an architect or civil engineer and having professional experience in a respective area of operation (3 to 5 years for those seeking a managerial position at construction works of exceptional significance, and 2 years for construction works of non-exceptional significance), as well as passing an examination on professional and legal knowledge. The qualification certificate of a manager of construction works of exceptional significance will grant the right to perform the duties specified in the certificate also at construction works of non-exceptional significance according to the relevant area of activity. Architects will not be able to take the positions of construction managers and construction operation managers at construction works of exceptional and non-exceptional significance, while civil engineers will have no right to become managers of the architectural part of a construction works design or managers supervising the implementation of the architectural part of a construction works design at construction works of exceptional and non-exceptional significance.

From 1 January 2017 qualification certificates of managers of construction works of non-exceptional significance will be issued by the Lithuanian Chamber of Architects for architects and the Construction Product Certification Centre for civil engineers. The Ministry of Environment would like to bring to the attention of architects and civil engineers that they have to obtain qualification certificates of a manager of construction works of non-exceptional significance in 2017 as from 1 January 2018 such a qualification certificate will be compulsory for the structural design, construction or technical supervision activity at construction works of non-exceptional significance.

Citizens and other natural persons of the European Union member states, the Swiss Confederation or signatory countries of the European Economic Area Agreement who exercise the rights of movement in the member states granted to them under the European Union legislation and wish to perform the duties of managers of construction works of exceptional and non-exceptional significance will have to obtain a document recognising their rights.

At present a consolidated draft version of the Construction Technical Regulation ‘Procedure for certification and recognition of rights of construction participants’ is being prepared which will be published on the information system of legal acts. Persons concerned will have the possibility to view the draft regulation and make comments and proposals.
