Amendments to the Construction Products Regulation favourable to manufacturers2014-06-26
The European Commission initiated the amendments to Annexes III and V to the Construction Products Regulation, simplified the declarations of performance of construction products and revised the performance assessment procedures. This will ensure greater clarity and flexibility in declaring the performance of different types of construction products.
The amendments to the Construction Products Regulation laying down harmonised conditions for the marketing of construction products include changes to two annexes. They establish the assessment and verification systems and the Declaration of Performance form.
From now on, the issued European Technical Approval (ETA) will be considered as an assessment of the performance of the characteristics of that product. It has been also established that now the manufacturer, who can declare the type of the product based on the completed assessments and verifications of the constancy of performance according to the established systems, is responsible for the determination of the type of the product. Earlier, the type of the product was determined by the Notified Body.
The approved form of the Declaration of Performance of construction products is more flexible, clearer and simpler, and some clauses are more defined. The clarifications on the completion of the Declaration provided by the drafters of the Declaration form are attached thereto.
The Declarations of Performance submitted to the market before the entry into force of this Regulation and complying with the provisions of the previously applicable Regulation will be deemed compliant with this Regulation.
The certificates issued by the Notified Bodies and other documents issued before the entry into force of these amendments to the Regulation are deemed compliant with this Regulation as well.
