Surface water and groundwater protection

Protection zones and shore protection strips of surface water bodies

To prevent hazardous substances from polluting surface water bodies, to protect the banks of water bodies against erosion, to ensure the stability of ecosystems of the shores of water bodies, to protect the natural landscape of the shores of water bodies and its aesthetic values, and to provide favourable conditions for recreation, etc., protection zones are established for all surface water bodies of Lithuania (except for industrial fish farming ponds, artificial non-flowing surface water bodies with the area not exceeding 0.1 ha, temporary artificial water bodies installed for the term of construction, and ditches), and shore protection strips are established in protection zones bordering on water bodies. The protection zone of a surface water body shall be a shore (land bordering on the water body) strip (area) where all economic activities that may have a negative impact on the surface water body are restricted. The shore protection strip of a surface water body shall be the part of the protection zone of the surface water body that borders on that surface water body where all economic activities may have a direct negative impact on the surface water body or may restrict public access; therefore, certain economic activities are restricted in that area.

The area of the protection zone and of the shore protection strip of a particular surface water body must be established according to the general principles for establishing protection zones and shore protection strips of surface waters approved by Order D1-98 On the Amendment of Order No. 540 “On the Approval of Rules for Establishing Protection Zones and Shore Protection Strips of Surface Waters” of the Minister of Environment of the Republic of Lithuania dated 7 November 2001 of the Minister of Environment of the Republic of Lithuania dated 14 February 2007. While establishing the area of the protection zone and of the shore protection strip of a surface water body, consideration must be given to various criteria describing the surface water body, such as the area of the water body, the rake of the slope, whether the water pond is natural or artificial, etc.

Economic and/or other activity forbidden and/or restricted in the protection zones and shore protection strips of surface water bodies are established by Article 20 of the Law of the Republic of Lithuania on Protected Areas (Official Gazette, No. 63-1188, 1993; No. 108-3902, 2001) and by Chapter XXIX “Protection Strips and Protection Zones of Water Bodies” of the Special Regulations for Utilisation of Land and Forest approved by Resolution No. 343 of the Government of the Republic of Lithuania (Official Gazette, No. 22-652, 1992; No. 2-43, 1996).

Administrative penalties shall be imposed on persons violating the regime of protection zones and shore protection strips of surface water bodies, viz. citizens shall be subject to a warning or a penalty of LTL 50-100, while officers – to a penalty of LTL 100-200. For violations of the regime of protection zones and shore protection strips of surface water bodies resulting in the damage caused to the water body, citizens shall be subject to a penalty of LTL 100-200, while officers – to a penalty of LTL 200-400.
